Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern access to and use of the Ontos website, workspaces, document analysis, and related services (collectively, the “Service”) provided by Ontos (“Ontos,” “we,” “us,” or “our”). By creating a workspace or using the Service, you agree to these Terms and the Privacy Policy. If you use the Service on behalf of an entity, you represent and warrant that you have authority to bind that entity.
2. Service
Ontos identifies potential scope gaps, coordination issues, and change-order risks in construction bid documents. Ontos uses automated and AI-assisted systems. Outputs may be incomplete or inaccurate and must be independently reviewed by qualified personnel. The Service does not constitute architectural, engineering, legal, accounting, lending, insurance, estimating, or construction-management advice.
3. Accounts and acceptable use
You are responsible for activity under your account and for authorizing workspace members. You may not bypass security controls, disrupt or probe the Service, upload malicious or unlawful material, submit content you are not authorized to disclose, or use the Service in violation of applicable law or third-party rights.
4. Customer Content
As between the parties, the customer retains all right, title, and interest in documents, project information, prompts, feedback, and other materials submitted to the Service (“Customer Content”). Customer grants Ontos a limited, non-exclusive, worldwide license to host, reproduce, transmit, render, and analyze Customer Content solely as necessary to provide, secure, maintain, and support the Service.
Ontos may use service telemetry, performance data, feedback, and aggregated or de-identified information to operate and improve the Service. Use of identifiable Customer Content for model development or product research is governed by the Privacy Policy and any separate permission provided by the customer.
5. Confidentiality, security, and deletion
Ontos will use reasonable safeguards to protect Customer Content and will not disclose it except to authorized users, service providers acting on Ontos’s behalf, as directed by the customer, or as required by law. Ontos will not make one customer’s Customer Content available to another customer or competitor.
A workspace administrator may request deletion by contacting privacy@joinontos.com. Verified requests will be handled in accordance with applicable law and applicable customer agreements, subject to permitted security, legal, and service-provider retention.
6. Suspension and termination
You may discontinue use of the Service at any time. Ontos may suspend or terminate access for a security risk, unlawful activity, nonpayment, material breach of these Terms, or risk of harm to Ontos or others. Provisions that by their nature should survive termination will survive.
7. Disclaimers and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ONTOS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW.
8. General
These Terms and any incorporated documents constitute the entire agreement concerning the Service and supersede prior discussions on that subject. If any provision is unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without Ontos’s consent; Ontos may assign them in connection with a merger, financing, reorganization, or sale of substantially all relevant assets.
We reserve the right to update this policy and usage after the update serves as agreement to the updated policy. Questions may be sent to legal@joinontos.com.
